Re: NAVB appeals CRG decisionNAVB did get favorable rulings in 2
or 3 TX appeals, just not the biggie about the swept funds. This appeal
is only regarding the award of attorney fees to CRG, although the swept
funds might get woven into the brief. CRG will probably cross-appeal
asking that the denial of the OH fees and two other sums be reversed.
CRG attorneys really made a colossal mistake in not asking the judge to
amend his Final Order within 30 days. The Final Order did not include
any pre-judgment interest and only 5% for post judgment interest. That
was a million dollar mistake on their part. As an aside, yesterday's 8K
and press release gives no clue as to the amount of the judgment being
appealed. Readers of this MB learned of the appeal before an 8K was
filed and importantly the amount of potential damages.
